Any content deemed as objectionable may be removed. By submitting content to the site, you, the visitor (hereafter referred to as the 'User') give EJ Enterprises the right to exhibit that material in any way. Any misuse of the Site by the User, including but not limited to, posting objectionable content, posting content under multiple accounts, or any attempt to use the Site in an unintended manner, will result in the revocation of said User's account and removal of all posted content.

By posting an Event on the Site, the User agrees that EJ Enterprises can not be held responsible in any way for the Event, does not endorse the Event, and has no role in the planning or production of the Event. EJ Enterprises Worldwide can not be held liable for the Event, regarding specifically but not limited to, Safety and Health, Ability to Perform, or Copyright Infringement.

EJ Enterprises makes no warranty, expressed or implied, as to the functionality or security of the Site, or of a user's account. EJ Enterprises will attempt to resolve problems with an account, but ultimately the resolution may result in the revocation of that account. By directing traffic or electronic requests to the servers hosting the Site or any related sites controlled by EJ Enterprises, the User agrees to and is bound by these Terms of Use. These Terms are subject to change.

USER hereby agrees to indemnify, defend, release, and hold harmless EJ Enterprises, its affiliates, directors, officers, employees, workers, and agents ("indemnified party") from and against any action, claim, cost, damage, demand, loss, penalty, or expense including but not limited to attorneys' fees, expert witness fees, and costs (collectively "Claims") imposed upon EJ Enterprises by reason of damages to property or personal injuries, including death, as a result of an intentional or negligent act or omission on the part of USER ("indemnifying party") in connection with the performance of this Agreement or other activities relating to the use of the Site which is the subject of this Agreement. The term "property" as used in this section shall include real, personal, tangible, and intangible property, including but not limited to, data, proprietary information, intellectual property, trademarks, copyrights, patents, and knowledge. In the event any action shall be brought against the indemnified party, such party shall immediately notify the indemnifying party in writing, and the indemnifying party, upon the request of the indemnified party, shall assume the cost of the defense thereof on behalf of the indemnified party and its affiliates and shall pay all expenses and satisfy all judgments which may be incurred by or rendered against the indemnified party or its Affiliates in connection therewith, provided that the indemnifying party shall not be liable for any settlement of any such action effected without its written consent. This Indemnification section shall survive termination of this Agreement, regardless of the reason for termination.

LIMITATION OF LIABILITY: IN NO EVENT SHALL EJ ENTERPRISES BE LIABLE TO USER, USER'S CUSTOMERS, OR ANY OTHER THIRD PARTY WITH RESPECT TO THE SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY, OR OTHER THEORY FOR ANY TYPE OF INDIRECT, CONSEQUENTIAL, INCIDENTAL, RELIANCE, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUES, OR LOST SAVINGS OF ANY KIND, ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE OBLIGATIONS OF EJ ENTERPRISES PURSUANT TO THIS AGREEMENT, WHETHER OR NOT EJ ENTERPRISES OR USER WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND WHETHER OR NOT SUCH DAMAGES WERE FORESEEABLE. EJ ENTERPRISES MAKES NO WARRANTY TO USER OR ANY OTHER PERSON OR ENTITY, WHETHER EXPRESS, IMPLIED, OR STATUTORY, AS TO THE DESCRIPTION, QUALITY, MERCHANTABILITY, COMPLETENESS OR FITNESS FOR ANY PURPOSE OF THE SITE PROVIDED HEREUNDER OR DESCRIBED HEREIN, OR AS TO ANY OTHER MATTER, ALL OF WHICH WARRANTIES BY EJ ENTERPRISES ARE HEREBY EXCLUDED AND DISCLAIMED.

This Agreement is entered into in the State of Florida and shall be governed by the laws of the State of Florida. Venue in any legal proceedings shall be in the Western Division of the Courts of Volusia County, Florida, USA.

Privacy Statement

EJ Enterprises does not make it's mailing lists public or available to third parties, however may make announcements on behalf of affiliated partners. Users have the option of opting out of email announcements at any time through their account administration page. EJ Enterprises can not be held accountable for attempts of harvesting User email addresses through electronic means, however we do our best to keep this information private. A User's Homepage / URL is considered public information and may be listed on or linked to from the Site, however listing a URL is optional and withdrawing it from a User's account profile will remove all reference to it from the Site.
